It will be possible to conclude contracts on the basis of clause 6, Part 1, Article 93 of Law No. 44-FK, including with the Roscosmos State Corporation
The deputies of the State Duma adopted in the third reading a law providing for the expansion of the list of organizations specified in paragraph 6 of Part 1 of Article 93 of Law No. 44-FL, with which contracts can be concluded without competitive procedures. Thus, after the signing of the relevant law by the President of the Russian Federation, a contract with a single counterparty can be concluded, including if the purchased works or services can be performed or provided only by Roscosmos State Corporation.
These changes will come into force on January 1, 2025 after the signing of the relevant law by the President of the Russian Federation.
Recall that according to paragraph 6 of Part 1 of art. 93 of Law No. 44-FL, as currently amended, the customer has the right to purchase work or services from a single counterparty, the performance or provision of which can only be carried out by an executive authority in accordance with its powers, or by a state institution, a state unitary enterprise, or a joint-stock company, 100% of which belongs to the Russian Federation, the corresponding whose powers are established by federal laws, regulatory legal acts of the President of the Russian Federation, regulatory legal acts of the Government of the Russian Federation.
