Groups and a list of goods, works, services have been approved, information on the procurement of which, according to Law N 223-FZ, is not posted on the official website of the Unified Information System
According to the order of the Government of the Russian Federation, information on the procurement of goods, works, and services is not subject to posting on the official website of the Unified Information System:
- belonging to one of the groups:
necessary to fulfill the state defense order, to form a stock of products, raw materials, materials, semi-finished products, components, provided for in paragraph 3 - paragraph 3.2 of Article 7.1 of Law N 275-FZ, and purchased by the legal entity specified in Part 2 of Art. 1 of Law No. 44-FZ, from among the organizations of the Roscosmos State Corporation, organizations of the rocket and space industry, which is the main contractor, the contractor participating in the supply of products under the state defense order;
purchased by the above-mentioned legal entity for the execution of a contract concluded with it in accordance with Law N 44-FZ, information and documents about which contained in the register of contracts are not subject to posting on the official website;
purchased by the above-mentioned legal entity to fulfill its obligations under an agreement concluded with a counterparty under a contract, information and documents about which contained in the register of contracts are not subject to posting on the official website;
purchased by a legal entity specified in Part 2 of Art. 1 of Law No. 223-FZ, for the execution of a contract concluded in accordance with Law No. 44-FZ by such person:
with the Roscosmos State Corporation, its subordinate government agencies, and the State Unitary Enterprise;
with the State Budgetary Institution, State Autonomous Institution, State Unitary Enterprise, other legal entity on behalf of the Roscosmos State Corporation;
with a legal entity to which funds for financial support of the contract were partially or fully provided within the framework of agreements on the participation of the Russian Federation in the property of the investment entity concluded with the Roscosmos State Corporation;
- according to the corresponding list in case of purchase by a legal entity specified in Part 2 of Art. 1 of Law N 223-FZ, for carrying out space activities.
In addition, regulatory legal acts establishing a list of goods, works, and services in the field of space activities, procurement information about which does not constitute a state secret, but are not subject to placement in the Unified Information System, were declared invalid:
- Order of the Government of the Russian Federation dated June 30, 2015 N 1247-r;
- Order of the Government of the Russian Federation dated November 6, 2015 N 2257-r;
- Order of the Government of the Russian Federation dated April 21, 2022 N 952-r.
Order of the Government of the Russian Federation dated March 29, 2024 N 744-r came into force on April 1, 2024 and is applied when making purchases, notices of which are posted in the Unified Information System, invitations to participate in which are sent, or if contracts with a single counterparty are concluded after the specified date.
Let us remind you that according to Part 16 of Art. 4 of Law N 223-FZ The Government of the Russian Federation has the right to determine, among other things, lists and (or) groups of goods, works, services, information about the procurement of which is not subject to posting on the official website of the Unified Information System. Currently in effect:
- List of services in the field of insurance of business and (or) political risks associated with export lending and investments, information about the purchase of which does not constitute a state secret, but is not subject to placement in the Unified Information System, approved. by order of the Government of the Russian Federation dated April 23, 2013 N 671-r;
- List of goods, works, services in the field of atomic energy use, information on the purchase of which is not subject to posting on the official website of the Unified Information System, approved. by order of the Government of the Russian Federation dated December 24, 2015 N 2662-r;
- List of goods, works, services in the field of production of bank notes, small change coins, forms of documents proving the identity of a citizen of the Russian Federation on the territory of the Russian Federation and abroad, government securities, excise and special stamps, postal payment marks, forms of strict accounting documents and reporting, the form of which is approved by the President of the Russian Federation, the Government of the Russian Federation or federal executive authorities, as well as personalization, storage and processing of documents in the interests of government bodies, procurement information of which does not constitute a state secret, but is not subject to placement in the Unified Information System, approved. by order of the Government of the Russian Federation dated September 27, 2016 N 2027-r;
- List of services for the transportation of goods of the first class of danger, weapons, weapons and military equipment, information about the purchase of which does not constitute a state secret, but is not subject to placement in the Unified Information System, approved. by order of the Government of the Russian Federation dated October 19, 2017 N 2298-r.
