Do antimonopoly authorities conduct unscheduled inspections of customers' activities under Law No. 223-FZ?

In their letter, the specialists of the FAS of Russia noted that the antimonopoly authority is not authorized to conduct unscheduled inspections of compliance with the provisions of Law No. 223-FZ in relation to the actions of control subjects. Consequently, the presence or absence of signs of violation of Law No. 223-FZ can be established only when considering the relevant complaint filed in accordance with Article 18.1 of Law No. 135-FZ, based on the provisions of the procurement documentation and all the circumstances of the case under consideration.
