They proposed a number of innovations in procurement under Laws N 223 and 44

Among other things, they want to change the form of the report on the volume of public procurement from small businesses and socially oriented non-profit organizations, as well as the rules for filling it out. Customers under Law N 223, who fell under sanctions, may be allowed not to comply with the requirements for the value of contracts based on the results of purchases among small and medium-sized businesses. Details below.

Report on the volume of public procurement from small businesses and socially oriented non-profit organizations.

From January 1, 2023, they plan to amend the form of the report on the volume of public procurement from small businesses and socially oriented non-profit organizations and the requirements for filling it out (subparagraphs "b" and "c" of paragraph 3 of the draft amendments). A number of formulations are brought into line with the new norm.

Federal and regional executive authorities, institutions and enterprises subordinate to them, as well as municipal medical organizations will fill out such a report for 2022 and 2023 differently. They will include, in particular, information on contracts for the supply of medicines and medical devices (subparagraph "a" of paragraph 3 of the draft amendments).

 

The minimum share of participation of small and medium-sized businesses under Law N 223.

From the new year, they may be allowed not to comply with the requirements for the total annual value of contracts that were concluded as a result of procurement among small and medium-sized businesses. We are talking about customers under sanctions who do not post information about procurement in the Unified Information System (subparagraph "a" of paragraph 2 of the draft amendments).

The amendment will also affect procurement planning, incl. innovative products. At the same time, they will be taken into account when calculating the annual cost volumes for small and medium-sized businesses (subparagraph "a", paragraphs 3-4, subparagraph "b", paragraph 2 of the draft amendments).

 

Purchasing from a single supplier.

The list of situations where information and documents from the register of contracts are not posted in the Unified Information System may include, in particular, purchases from a single supplier (clause 4 of the draft amendments):

- work on mobilization preparation;

- services to ensure visits of high-ranking foreigners;

- goods, works, services for the preparation and holding of elections, a referendum;

- access services to foreign documentary, abstract, full-text and other databases.

It is planned that the innovations will come into force 7 days after their official publication in the form of a government decree.
