They proposed new standard conditions for state contracts in the field of capital construction
Standard conditions are planned to be used in the procurement of construction, reconstruction, overhaul, demolition of a capital construction facility and the preservation of cultural heritage sites.
The conditions will be supplemented, in particular, with clauses on securing the contract and warranty obligations, the rights of the customer and the contractor. Among the new responsibilities of the latter are the following:
- inform the customer about all subcontractors within 10 days from the date of conclusion of the contract with them. This must be done if the total price of such contracts is higher than 10% of the contract price;
- free the site from temporary structures, equipment and debris no later than 10 working days from the date of completion of work. Now this term is chosen by the parties;
- perform a number of works for the amount of at least 25% of the contract price. We are talking about works from the mandatory list, which were determined at the suggestion of the contractor.
The contract will include the obligation of the customer to assist the contractor in the work and write off the penalty when required by law. The source of financing will be indicated in the price clause of the contract.
There are other innovations as well.
The amendments are expected to come into force on January 1, 2023. They will apply to purchases announced after this date.
Public discussion of the project will end on November 15.
