On November 01, the Cabinet of Ministers of the Republic of Tatarstan held a briefing on measures of economic support for business to ensure the stability of the Russian economy in conditions of partial mobilization.
Ruslan Sabirov, Chairman of the State Procurement Committee of the Republic of Tatarstan, spoke about the measures taken to support entrepreneurs in the field of procurement.
In particular, the Chairman noted 3 key points:
1. Rules for maintaining the Register of Unscrupulous suppliers.
The rules clarified: the register does not include data on the participant who evaded signing the contract, or the supplier who did not fulfill obligations under it due to force majeure. We are talking, among other things, about mobilization.
2. Write-off of penalties in state and municipal procurement.
Customers write off penalties for non-performance or improper performance of the contract according to the previously established rules approved by the Decree of the Government of the Russian Federation dated 04.07.2018 No. 783, including if:
- obligations were not fully fulfilled due to mobilization;
- there is a written justification that it is impossible to fulfill the contract for this reason. Supporting documents must be attached to the justification (if any);
- there is an acceptance certificate or other document that proves the fulfillment of obligations under the contract (if there was one).
Accrued and unpaid penalties will be written off in full.
3. Change of the state and municipal contract due to unforeseen circumstances.
From March 2022, in accordance with part 65.1 of Article 112 of the Law on the Contract System, it became possible, by agreement of the parties, to change the essential terms of the contract concluded before 01.01.2023, if circumstances beyond the control of the parties to the contract arose during the execution of such a contract, entailing the impossibility of its execution. The validity period of this norm will be extended for a year.
It is also noted that in accordance with the decree of the Government of the Russian Federation dated 10/15/2022 No. 1838, the right of the customer to change the essential terms of the contract in connection with mobilization in the Russian Federation is fixed.
