FAS reminded: the operator does not check the documents of the public procurement participant for compliance with additional requirements
The controllers were complained that the EP operator did not check whether the company's documents meet additional requirements. There was no acceptance certificate, but the operator placed the documents in the register of accredited participants. The application was rejected.
The operator explained that he acted according to the law. He studied the documents on the rules of interaction between the operator and the participant of the purchase, then placed them in the register.
The inspectors did not find any violations:
the operator checks only the availability of information and documents of the participant according to the rules of interaction, but does not assess whether they meet additional requirements;
the risk of inconsistency or unreliability of data in the registry is borne by the participant.
The FAS has come to similar conclusions before.
