The state customer was offered a product with a different code OKPD 2 — FAS found no reason to reject the application
In a purchase with a ban on the admission of foreign manufactured goods, one of the applications was rejected. The customer did this because he saw a different code in the product registry entry
OKPD 2 — it did not match the code in the notification. The participant did not specify the registration numbers of the products needed by the customer.
Supervisors found a violation:
- the application offered a similar product. Its name corresponded to the object of purchase. The participant confirmed his Russian origin;
- The OKPD 2 code is not attributed to functional, technical or qualitative characteristics. The customer specified the required code in the notification, but this does not mean that the participant's products did not suit him. Its parameters met the conditions of purchase.
Note that the FAS has expressed this position before. However, the Irkutsk UFAS supported the customer in a similar decision, since the specifics of his work did not allow him to purchase a similar product with another OKPD 2.
