The customer purchased drugs from the list of VED and established admission restrictions. The participant's application was rejected — he did not confirm the country of origin of the goods.
According to the participant, the customer acted illegally. He purchased 6 drugs with different international nonproprietary names (INN), and the national regime can only be used in the procurement of medicines with one name.
The controllers supported the participant. If the object of purchase is drugs with different INN, admission restrictions are not applied. The application should not have been rejected.
Similar conclusions were reached, in particular, by the St. Petersburg and Chelyabinsk UFAS.
