UFAS: if the data on the participant of public procurement is in the RNP according to Law N 223-FZ, there is no reason to reject the application

The customer demanded that there be no information about the participants of the purchase in the register of unscrupulous suppliers. The application of one of them was rejected for non-compliance with this condition.

Supervisors found a violation:

information about the participant is only in the register according to Law No. 223-FZ;

according to the Law No. 44-FZ, another register is maintained. State customers have the right to demand that the data about the counterparty is not only in this register.

Similar conclusions were reached, in particular, by the Mari UFAS.
