Court: experience in construction procurement with additional requirements can be confirmed by a subcontract

The customer held a construction auction with additional requirements. To confirm the experience, the participant submitted, among other things, a copy of the subcontracting agreement. He was allowed to purchase.

The supervisors decided that in this case only contracts or general contracts are suitable. However, the courts supported the customer: it does not matter whether the participant was a general contractor or a subcontractor.

Note: FAS has repeatedly expressed otherwise.
