They explained under what circumstances it is possible to change the long-term construction state contract
According to Law No. 44-FZ, customers have the right to change the term and / or price of a long-term construction contract in the event of unforeseen circumstances that make it impossible to fulfill it. To do this, you must meet a number of conditions: a
contract with a price of 100 million rubles and above is concluded for a period of at least 1 year;
there is a decision of the government, the highest executive body of the state power of the region or the local administration;
the planned changes to the terms of the contract do not increase the term of its execution and (or) the price by more than 30%.
The Ministry of Finance, the Ministry of Construction and the FAS explained that it is possible to adjust the contract in this way, in particular, when the price of construction resources changes.
