The Ministry of industry and trade: the prohibition of the admission of foreign goods to procurement policy applies to apostasia

The Ministry has given another explanation of how to apply the prohibition of admission of foreign goods to procurement in the list of Resolution No. 616. This time, the Agency recalled which methods of procurement are subject to the prohibition of admission and what is meant by a set of goods when determining exceptions.

Which purchasing methods are subject to the admission ban
The Agency reported that the ban on the admission of foreign goods listed in the list of Decree N 616 applies to all methods of procurement, including the purchase from a single supplier. In the latter case, the supplier provides an extract from the register of Russian industrial products (the register of Eurasian industrial products) indicating the numbers of registry entries at the stage of contract execution.

What is meant by a set of products to determine exceptions to the prohibitions of admission
Sub-item "b" of item 3 of The resolution N 616 establishes one of the grounds for non-application of the ban on admission of foreign goods to purchases. The exception is triggered if one of the following conditions is met:
-the purchase includes one unit of goods, the cost of which does not exceed 100 thousand rubles;
-the purchase includes a set of such goods, the total cost of which is less than 1 million rubles (with the exception of purchases of goods specified in items 1-7, 124 and 125 of the list).

The Agency explained: in this case, a set of goods should be understood as those goods that correspond to the same code for OKPD2. In other words, when purchasing a set of goods, the ban should not be applied if the following conditions are met simultaneously:
-products belong to the same code for OKPD2;
-NMC is less than 1 million rubles.
-the cost per unit of each product does not exceed 100 thousand rubles.

If the subject of the contract is made up of goods from the list that belong to different codes for OKPD2, the possibility of not applying the ban on this basis is set for each product separately.

Recall that the Ministry of industry and trade has previously given a similar explanation on this issue, and also told how to apply the "third extra" mechanism in case of restrictions on the purchase of foreign goods.
