The lack of electricity was a good reason for violating the deadline for signing the state contract
The customer sent the winner of the purchase a draft state contract. He did not sign it in the appointed time, so the customer appealed to the control body with a statement on the recognition of the winner evaded the contract. The Moscow FAS included the violator in the register of unfair suppliers.
However, the courts did not support this decision. The winner was unable to sign the contract due to lack of electricity on the last day allotted for this purpose. At the same time, he listed the security of the contract and was subsequently ready to sign the contract any day.
The courts considered the winner's actions to be in good faith, and the punishment for including him in the RNP was disproportionate.
