The Ministry of Finance finalized amendments to additional requirements for participants in public procurement of construction works
The Office finalized the previously prepared draft amendments to the additional requirements for participants in the procurement of "construction" works. In the new project, the requirements were adjusted, and also additional cases were indicated when they would have to be installed.
“Construction” purchases with NMCC above 10 million rubles.
Participants will not be able to confirm their experience with an executed contract (contract) (hereinafter referred to as the contract) for overhaul, demolition of the capital construction object when purchasing construction, reconstruction of linear and non-linear capital construction objects.
In separate grounds made the purchase of works:
overhaul of a non-linear object of capital construction. You can confirm your experience with a contract for the construction, reconstruction, and overhaul of a non-linear capital construction project;
on the demolition of a non-linear object of capital construction. Experience can be confirmed by a contract for construction, reconstruction, demolition of a nonlinear capital construction project.
Similar rules are provided for the procurement of works on overhaul, demolition of a linear facility. Experience in these cases is confirmed by the contract, the subject of which is both work on a linear and non-linear object. This cannot be done now.
The new version of the project provided that the cost of the confirming contract should be at least 10% of the NMCC, if it is above 5 billion rubles.
New “construction” purchases
The list of cases when additional requirements are needed included new positions. So, they will need to be installed when purchasing engineering surveys for the preparation of design documentation, construction, reconstruction of a nonlinear capital construction facility.
The participant will confirm their experience, among other things, with a completed contract:
to perform relevant work on a nonlinear capital construction facility;
to carry out work on the preparation of project documentation to ensure the construction, reconstruction of a nonlinear capital construction object, its parts (if the contract contained an assignment for engineering surveys).
The cost of such a contract should be at least 20% of NMCC.
Competitions with limited participation in special facilities and roads
As in the first edition of the project, it is planned that customers will establish additional requirements in tenders with limited participation if the NMCC exceeds 100 million rubles. for the purchase of works on the construction and (or) reconstruction of special objects of capital construction, roads. Participants in such purchases will not be able to confirm their experience with an executed contract for a major overhaul or demolition of such an object.
The new version of the project stipulated that the cost of the confirmation contract should be:
not less than 20% of NMCC, if it exceeds 100 million rubles;
not less than 10% of NMCC, if it is above 5 billion rubles.
Work on overhaul, demolition of such facilities was carried out in separate grounds. Additional requirements for participants in such purchases will be identical to those that are currently in effect when purchasing construction works for special facilities, roads.
The list of types of work supplemented. For example, it included work on engineering surveys for the preparation of project documentation, for the construction, reconstruction of special capital construction facilities, roads.
Public discussion of the project will last until June 16, 2020. If the document is accepted, then it will not apply to purchases that are placed in the UIS until the day it enters into force.
