FAS explained how to confirm compliance with additional requirements for public procurement of construction works

The Agency explained what should be taken into account when providing participants with documents confirming compliance with additional requirements, namely, whether the application requires appendices to them.

A copy of the permission to put the object into operation

This is one of the documents that confirms that the purchasing participant meets additional requirements (except in some cases). A copy of the permit will be required, for example, when purchasing work on the construction of a capital construction facility with an NMCC of more than 10 million rubles.

The form of the named document indicates that it is invalid without a technical plan. The Antimonopoly service explained: in the Decree of the Government of the Russian Federation from 04.02.2015 N 99 there is an exhaustive list of supporting documents. There is no technical plan among them. Therefore, you do not need to provide it in the application.

A copy of the executed contract (agreement)

Participants in purchases with additional requirements confirm their experience, among other things, with a copy of the executed contract or agreement.

The FAS indicated that it is possible to provide a copy without accompanying appendices, such as design and estimate documentation. Their absence in the application does not mean that the participant does not have the relevant experience. In the Resolution of the Government of the Russian Federation of 04.02.2015 N 99 there are no requirements for the form and procedure of registration of supporting documents.
