How can I change the price of a state contract for the purchase of turnkey construction works"
From may 1, the procedure for changing the price of the contract for the purchase of works for the construction of a "turnkey" facility will be in effect.
When the order will be applied.
It will need to use if you change the price of the contract the subject of which are works on preparation of project documentation and (or) carrying out engineering surveys, construction, reconstruction and (or) capital repairs of object of capital construction, and equipment supply.
The object for which work will be performed must be included in the lists of capital construction objects approved by the government, the highest Executive body of the subject of the Russian Federation, and local administrations.
The document will need to be followed if during the execution of the contract during the examination of project documentation:
- the estimated cost of construction, reconstruction, overhaul exceeded the contract price;
- the contract price exceeded the estimated cost of construction, reconstruction, and overhaul.
Who will use the order.
They will be guided by:
- state and municipal customers;
- budgetary institution;
- state and municipal unitary enterprises.
What to consider when changing the contract price.
The price can be adjusted only after the development of project documentation and (or) engineering surveys, as well as receiving a positive expert opinion of the estimated cost.
If the estimated cost is exceeded, the customer must change the essential terms of the contract so that they do not increase the price by more than 30%. To change the contract, a decision of the government (for Federal needs), the highest Executive body of the state power of the subject of the Russian Federation (for the needs of the subject), and the local administration (for municipal needs) will be required.
The contract price above the estimated cost must be reduced.
You can change the price using the formula specified in the Order.
How to make changes.
Adjustments to the contract price will need to be made by an Addendum. Its form is not set.
