In particular, MoE noted that when placed in the register of procurement participants accredited to an electronic platform of documents provided by the parties in accordance with Annex No. 1 to decree of the Government of the Russian Federation from February 4, 2015 № 99 (hereinafter – Decree No. 99), the operator of an electronic platform provides only check their "completeness". At the same time by virtue of part 2 of article 69 of the Law of April 5, 2013 No. 44-FZ "on the contract system in the field of procurement of goods, works, services for state and municipal needs" verification of the relevance of work experience, equipment in order to make a decision on the compliance or non-compliance of the procurement participant with additional requirements provided for by Resolution No. 99 is carried out by the Commission of the customer within a specific purchase.
Recall that according to part 2 of article 31 of the Law No. 44-FZ, the RF Government is entitled to set to the participants of procurement of certain types of goods, works, services, purchases which are made through competitions with limited participation, two-stage tenders, closed tenders with limited participation, closed two-stage tenders or auctions, additional requirements, including the availability:
financial resources for the execution of the contract;
on the right of ownership or other legal basis of equipment and other material resources for the performance of the contract;
work experience related to the subject of the contract and business reputation;
the required number of specialists and other employees of a certain level of qualification for the performance of the contract.
Pursuant to this provision, Resolution No. 99 establishes additional requirements for participants in the procurement of certain types of goods, works and services.
