FAS revealed the main errors in public procurement in October 2019
The state order placement control Department of the FAS of Russia has prepared a review of administrative practices, which lists common errors in public procurement for October 2019. Let's consider the main ones.
Wrongfully rejected the application during the auction
An auction was held for the supply of consumables for medical equipment. The application was rejected because the participant offered to deliver goods incompatible with the customer's equipment. However, it turned out that the terms of reference do not specify the requirement for compatibility of consumables.
Established an improper procedure for evaluating the application
According to the tender documentation, the Commission, in order to assess the qualification of the participant, had to take into account the number of full-time employees. The Supervisory authority concluded that this evaluation procedure did not allow for the identification of the best condition for the performance of the contract. Evaluation of specialists who are exclusively in the staff of the procurement participant does not indicate the best condition for the execution of the contract and limits competition.
Failed to comply with the procedure for unilateral refusal to perform the contract
The customer has decided to unilaterally refuse to perform the contract. This decision was not placed in the EIS due to a technical failure within the prescribed period. It was telegraphed to the contractor. However, the text did not specify the reasons for the decision.
Did not justify the reason for refusal in the Protocol of consideration of applications
The participant was denied admission to the auction. The Commission reflected this information in the Protocol of consideration of applications in the form of the reference to norm of the Law N 44-FZ. However, it did not specify the rationale for the decision to refuse.
Demanded from participants document on old form
The customer held a competition with limited participation to perform construction works. In the information card of the tender documentation, the requirement to submit an extract from the register of members of self-regulatory organizations in the field of construction in a certain form was specified. However, the order that approved the form of such an extract, at the time of the purchase has lost its force.
