What purchases will be subject to bans
The draft amendments to Resolution N 239 are supplemented by the prohibitions established by Resolutions N 656, 791, 1072 and 9. These acts should become invalid from January 1, 2020.
It is planned that the ban on the admission of foreign goods from the list to the project will be established only when purchasing for the needs of defense and security of the state. Now such restriction is provided only in Resolutions N 9 and 239.
If the project is approved in this edition, customers will be able to buy for their own needs without the application of prohibitions of goods of light, furniture, woodworking industry and some goods of mechanical engineering. Instead of bans for these goods, they plan to establish restrictions on the admission of foreign goods.
What products will be included in the new list
Most of the goods that are now subject to the ban will be included in the new list. The ban will apply not only to goods, but also to works and services with which goods are purchased.
For group of goods of light industry the list 1 approved by the Resolution N 791 is taken as a basis.
Some commodity groups want to significantly add to it. In particular, the list is planned to include more items:
heavy machinery products (Central air conditioners, electric furnaces), etc.);
agricultural machinery (loaders and unloaders, machines for cleaning, sorting or calibration of seeds, grains or dry legumes, etc.);
food engineering (refrigeration and freezing equipment for food processing industry, dishwashers, etc.);
construction and road engineering (pavers, copra and copra equipment for pile works, etc.).
There will be a new category of goods, which were not previously covered by the ban. These are goods of the shipbuilding industry and marine equipment: river and sea vessels, ferries, tugs, etc.
Some items were not included in the new list. Among them:
08.11.1-stone for monuments and construction;
08.12-gravel, sand, clay and kaolin;
23.11-sheet glass;
28.92.50.000 — a crawler tractors;
29.10.59.210-means of transport for transportation of monetary proceeds and valuable cargoes.
How will bans be applied
The uniform rules of application of bans for all goods from the list are offered. They will not be allowed to purchase if they do not originate from the EAEU countries. As now, in one purchase there can be no goods included in the list and absent in it.
To confirm the Russian origin of the goods, in the application (final offer) the participant will submit an extract from the register of Russian industrial products, which is formed with the help of GIS.
Confirmation of the origin of goods from the EAEU country will be the presence of goods in the register of Eurasian industrial products. The project does not specify how the participant must prove that his goods are in the register.
When purchasing certain items, you will need to set an additional requirement for participants. In the production of textile products listed in the project, they will have to use fabrics, materials or semi-finished products from the list originating from the EAEU countries. There is no such requirement for the procurement of furniture and woodworking products, which is currently in force, in the project.
When performing the contract, it will be impossible to replace the goods from the list with foreign products.
Within 10 working days after the conclusion of the contract, the customer will be required to post information about the results of the purchase through the GIS.
What will be the exceptions to the application of prohibitions
The cases when the bans will not need to be applied are proposed, in particular:
the customer has a permit for the purchase of foreign goods, issued with the help of GIS;
the purchased goods are incompatible with the goods that the customer already has;
it is necessary to purchase spare parts and consumables for machines and equipment of the customer according to technical documentation.
When will the new rules work
New bans will need to be established from January 1, 2020. They will not need to be applied to purchases initiated before that date.
