Standard contracts developed by the Ministry of industry and trade of Russia have been adjusted
Since March 3, the provisions of standard contracts approved by the order of the Ministry of industry and trade of Russia dated March 12, 2018 № 716 are set out in the new edition.
Changes to contracts:
on rendering of services of exhibition and fair activity for ensuring the state and municipal needs;
on rendering services in diagnostics, maintenance and repair of vehicles for providing the state and municipal needs;
on delivery of production of the radio-electronic industry, the shipbuilding industry, aircraft equipment for ensuring the state and municipal needs.
In particular, the provisions of these standard contracts on advance payment terms have been adjusted. It is determined that the advance payment at the last stage of the contract is not paid.
Also in accordance with the current version of paragraph 2 h.13 article 34 of the Federal law of April 5, 2013 № 44-FZ "on the contract system in the procurement of goods, works, services for state and municipal needs" are the wording of notes to the contracts containing the rules of payment if taxes, fees and other mandatory payments are payable by the customer.
In addition, it is prohibited to change the contractor, except if the new contractor is the successor of the contractor due to the reorganization of the legal entity.
