The Ministry of Finance clarified the consideration of regional holidays when calculating deadlines under 44-FZ
The Russian Ministry of Finance stated in its explanation that when calculating the time limits set in working days under Law No. 44-FZ, non-working holidays are not taken into account. At the same time, the agency allowed the possibility of applying regional non-working holidays, if they are established by the subject of the Russian Federation.
The Agency recalled that the legislation on the contract system is based on the norms of the Civil Code of the Russian Federation. As a general rule, if the deadline is explicitly set in working days, then non-working (holidays) days are not taken into account. Since 44-FZ does not contain special rules for regional holidays, the general provisions of civil legislation apply.
The explanation is relevant when determining the time frame for signing a contract, performing procurement procedures, as well as the timeliness of the performance of duties by the customer or participant.
