FAS Russia recommends that procurement participants use SIS "Independent Registrar" to protect their rights with participation in electronic procedures
FAS Russia experts in their letter noted that the screenshots do not allow to verify their authenticity and can not indicate the presence or absence of technical problems in the operation of the electronic platform. At the same time, SIS "Independent Registrar" provides video recording of all actions of procurement participants carried out by them on electronic platforms, when conducting electronic purchases on them in accordance with the Federal law of April 5, 2013. № 44-FZ" on the contract system in the procurement of goods, works and services for state and municipal needs "and the Federal law of July 18, 2011 № 223-FZ"on procurement of goods, works and services by certain types of legal entities".
It is emphasized that the specified information system records including availability of electronic platforms, availability of access to the Internet and setup of the workplace of the user. In particular, it can be used to record cases of technical problems in the work of the operator of the electronic platform, including when applying for participation in the purchase and submission of price proposals, the conclusion of a contract with the customer. Data of video recording of GIS "Independent Registrar" can be submitted to the FAS of Russia to confirm the presence or absence of technical problems in the performance of the electronic platform.
Thus, procurement participants are encouraged to use the SIS "Independent Registrar" to protect their rights and legitimate interests when participating in electronic procedures.
