Federal Antimonopoly Service have updated the regulations of public procurement № 727/14, adopted November 19, 2014. Updates relating to the complaints procedure. Terms of consideration and terms of other activities remained unchanged.
Under the amendments, after receipt of the complaint and the rest of her text data are published in a unified information system public procurement. Since this system has not yet been put into operation, information about complaints should be published on the official website of the Russian Federation. This action will disclose information about placing an order.
The result of the meeting is to be adjudication in which the Commission will order to eliminate the revealed violations or explain the failure of the complaint. If necessary, the complaint and the material on it will be passed to other authorities for legal action on administrative violation and (or) the antitrust laws. Also, the Commission may adopt other measures, such as direct materials appeal to law enforcement agencies, the courts, in the supervisory bodies of procurement, etc.
Complaints made to the results of the evaluation of applications, requests for proposals and final proposals for individual criteria will not be considered.
