The Federal Antimonopoly Service (FAS) of Russia has published a letter clarifying a number of provisions of Order No.894/24 regarding the procedure for calculating the cost of diesel fuel. In particular, it was noted that the customer independently determines the conversion rate to different types of fuel depending on the season.
According to the technical regulations approved by the decision of the Customs Union Commission of October 18, 2011 No. 826, diesel fuel is divided into four types: summer, winter, Arctic and off-season. These differences take into account the climatic operating conditions of the vehicle, which affect the viscosity and other properties of the fuel.
FAS stressed that when calculating the initial maximum contract price (NMCC) or the contract price, it is necessary to base on current market prices. This is especially true in cases where fuel is supplied by refueling directly from the supplier's tanker into the customer's tank, which qualifies as retail sale.
When forming the NMCC, customers can use the coefficients and indicators provided for in paragraphs 7 and 8 of the Procedure. However, these coefficients and indicators must be calculated and justified by the customer independently.

Thus, the decision on the choice of coefficients and indicators remains with the customer, who is responsible for the correctness of calculations and the validity of the applied values.
