The Ministry of Finance of the Russian Federation has finalized a resolution on additional requirements for procurement participants
The Agency proposed to make (Project ID 01/01/07-24/00149453) the following changes to the Decree of the Government of the Russian Federation dated 12/29/2021 No.2571:
- to apply additional requirements regardless of the scope of the customer's activities;
- establish an additional requirement for the experience of participants in the procurement of services for washing, cleaning (including chemical) of textile products; (except if the NMCC does not exceed 500 thousand rubles).
- to provide for the provision by the procurement participants of contracts on the experience of performing works that do not require a permit to put an object of capital construction into operation, only if such an agreement is concluded and executed in accordance with Law No. 44-FZ or Law No. 223-FZ.
If there is a permit for the commissioning of a capital construction facility, it is possible to provide a civil contract.
to clarify the list of supporting documents (information), including:
- for participants in the purchase of catering services and (or) the supply of food products purchased for organizations engaged in educational activities, medical organizations, social service organizations, recreation organizations for children and their rehabilitation - the absence of a criminal record for crimes provided for in Article 236 of the Criminal Code of the Russian Federation (with the exception of persons whose criminal record has been extinguished or withdrawn) from the participant of the purchase, who is an individual, or the head, members of the collegial executive body, the person acting as the sole executive body, the chief accountant of the participant of the purchase, who is a legal entity.
- to establish that the concept of a "construction contract" contained in Resolution No. 2571 is used in the meaning provided for in part 2 of Article 52 of the Civil Code of the Russian Federation and, accordingly, means a contract for the construction, reconstruction, and overhaul of capital construction facilities concluded by the procurement participant directly with the developer, the technical customer, the person responsible for the operation of the building, facilities or a regional operator.
