They want to clarify the rules of medical public procurement from a single supplier and lower the threshold for offset contracts
Anti-crisis measures - 2022 Law No. 44-FZ Contract (44-FZ) Sole Supplier
On April 20, amendments were adopted in the first reading, including to Law No. 44-FZ.
Now it is possible to purchase medicines, medical products and consumables in a non-competitive way according to clause 5.1 of Part 1 of Article 93 of Law No. 44-FZ, subject to a number of conditions. State or municipal medical organizations have such an opportunity.
The government, in particular, offered to allow other customers to purchase on the specified basis. Medical products and consumables can be purchased according to the rules of the "electronic store".
By the end of the year, customers will be able to adjust the amount of medicines, medical products and consumables under the contract within 30%.
They also plan to clarify the specifics of purchases under offset contracts, for example:
to reduce from 1 billion to 100 million rubles. the minimum amount of investments that a supplier-investor must make under such a contract. It will amount to at least 400 million rubles, if the contract is concluded for several regions;
to fix the mandatory conditions of the offset contract. One of them is the maximum quantity of goods (services) that the supplier—investor can provide directly to other customers of the region during the year. It should not exceed 30% of the products produced. There is an exception when such a restriction can not be applied.
