Determined what conditions of state construction contracts can be changed due to unforeseen circumstances
If during the execution of the construction contract circumstances arise due to which it cannot be executed, then in 2022, among other things, you can change:
- volume and (or) types of work under the contract, specifications and types of equipment from the project documentation;
- the amount of the advance. On this basis, it can also be established if the parties have not done this before;
- the procedure for acceptance and payment of a separate stage of the execution of the contract, the results of the work performed.
Changes can be made within the LBO.
To do this, the counterparty sends the customer a documented proposal and a signed draft agreement on the adjustment of the contract.
The customer has 10 business days to:
- sign the agreement, send it to the counterparty and include information about the changes in the register of contracts;
- inform the counterparty in writing about the refusal to sign and justify it.
The government recommends that customers also take into account innovations under Law N 223-FZ.
The changes took effect April 18.
