Courts: a copy of the certificate for medical products in the application for participation in public procurement must be submitted in full
The participant's application was rejected because he submitted copies of certificates for medical devices without attachments.
Controllers c recognized the customer's decision as illegal:
the application has the first pages of the certificate with the details of the document. This is enough to get all the information in the state register of medical products;
there is no requirement to provide a full copy in the purchase.
The courts supported the customer:
in the form of the certificate it is indicated that it may have an appendix - an integral part. It contains all the components and characteristics of medical products. If available, it should be included in the application;
the customer checks the information in the registry, but does not collect it for the participant. The possibility of such a check does not relieve the participant of the obligation to submit documents in full;
the inability to provide copies of certificates with attachments was not proved.
