The customer refused to fulfill the contract because the company did not deliver the goods on time. The controllers did not include the information in the RNP.
The courts supported them because the society:
* informed the customer that restrictions were imposed in the country of the manufacturer of the product in connection with the coronavirus. Because of this, it is impossible to deliver the goods on time;
* * offered the customer to terminate the contract by agreement of the parties or suspend its operation;
* notified about the possibility to fulfill obligations and deliver the goods by the end of the year.
A similar position is taken, in particular, by the AS of the Ural District.
