Approved new rules for conducting RNP in public procurement

Since July 1, the procedure for sending data to the RNP has changed. The government has published new rules for maintaining the register instead of the old ones. Customers will prepare an appeal to the control body. The rules, among other things, provided for the procedure for its referral and consideration. Read more in the review.
It is impossible to withdraw the appeal (p. 11 of the rules).
It should be noted that transitional provisions are provided for e-procurement. Until April 1, 2022, appeals to the control body are submitted in paper form.
Consideration of the application and making a decision
The supervisors have 5 working days to consider the application and make a decision from the day following the day of receipt of the application (p. 11 of the rules). If you send an appeal not under your jurisdiction, the procedure will take longer (p. 9-10 of the rules).
We have established the reasons why the information will not be included in the RNP. So, if the basis of the appeal is evasion from concluding a contract, the reason may be a violation of the procurement legislation when determining the supplier. In case of unilateral refusal-violation of the procedure for such refusal (p. 13-14 of the rules).
The controllers will inform about their decision in the same way as the appeal was sent. As before, when the information is included in the registry, they will create an entry. When determining the date of inclusion in the RNP, the time zone of the controllers is taken into account (p.15 of the rules).
The new rules also provide for the procedure for correcting technical errors in the RNP (p. 16 of the rules).
Exclusion of information from the RNP
The information will be excluded from the RNP automatically after 2 years from the date following the date when such information should be included in the register, and not from the date of its entry into the RNP (p.16 of the rules).
We have fixed cases when information can be excluded from the RNP ahead of time. This will happen if, for example, the customer's decision on unilateral refusal is recognized as illegal or invalid (p.16-17 of the rules). The procedure for early exclusion from the register is also provided for (p. 17-20 of the rules).
The rules came into force on July 1, except for certain provisions.
