The Ministry of transport proposes to approve the rules for life cycle contracts

The Ministry of transport proposes rules on which it is necessary to conclude life cycle contracts. In the draft government decree, the Agency listed the terms of contracts and rules of financing.

The authors of the project propose to regulate the order in which they conclude life cycle contracts in accordance with part 16 of article 34 of Law No. 44-FZ. If the term of the contract exceeds the period of implementation of the program under which funding is received, the contract will be concluded on the basis of decisions:

Governments – for Federal needs;

the highest official of the region – for regional needs;

the head of the municipality – for the municipal needs.

The contract for design, construction or reconstruction and commissioning will include conditions:

preparation of project documentation in accordance with the design assignment of the capital construction project, which was approved by the customer before the contract;

the order of works provides architectural and construction design, engineering surveys;

the estimated cost of construction or reconstruction is determined according to the project documentation with a positive conclusion of the state expertise;

the price of the contract and the provision on change of the price of the contract approve after the positive conclusion of the state examination of project documentation and reliability of determination of estimated cost.

The contract for design, construction and commissioning will be financed on the basis of the decision on the preparation and implementation of budget investments in state or municipal property.

The customer has the right to conclude a life cycle contract in cases that the Government approved by the decree of 28.10.2013 No. 1087. Such contracts include the purchase of goods and works, subsequent repairs and maintenance and, if necessary, the operation and disposal of goods or works.
