Documentation on the purchase of construction works under the Law № 44-FZ, must contain a conclusion on the reliability of the estimated cost of construction
This conclusion was reached by experts of the Ministry of Finance. They believe that the use of design and estimate documentation included in the auction documentation and does not contain an opinion on the reliability (unreliability) of determining the estimated cost of construction, reconstruction, capital repairs of the capital construction project, works on the preservation of the cultural heritage object, does not comply with the provisions of the town-Planning code, as well as the Federal law of April 5, 2013. № 44-FZ "on the contract system in the procurement of goods, works and services for state and municipal needs", hereinafter – the Law № 44-FZ.
Recall that in accordance with Art. 8.3 and Art. 48 of the Urban planning code of the Russian Federation in the project documentation, among other things, includes estimates for construction. The estimated cost of construction, financed by the budgets of the budget system of the Russian Federation, funds of state-owned companies, is subject to verification for the reliability of its determination in the manner prescribed by the government of the Russian Federation on may 18, 2009 № 427. The results of the validation of the estimated cost shall be presented in the form of a conclusion about the reliability or unreliability of determining the estimated cost of construction, reconstruction, capital repair of object of capital construction, works on preservation of object of a cultural heritage.
