FAS: the state customer can not reject the application, in which more goods are offered than necessary

In the opinion of the antimonopoly body, the offer of the procurement participant to deliver goods in a larger quantity does not give grounds for rejecting the participant's application.

Let's note, earlier the similar position was and in judicial practice.

Procurement participants may be forced to submit such proposals because of the volume of the individual package or the dosage of their goods. We recommend not to reject the application even when the participant was simply mistaken.
