A state procurement participant has the right to submit an extract from the registry of the SMB instead of a declaration of ownership

14 February 2018, Wednesday

The AC of the North-West district supported the position of the antimonopoly authority, pointing out that Law No. 44-FZ does not provide for a strict form of a declaration on the ownership of the procurement participant in the SMB. The essence of the declaration is of legal importance, and not its form.

Accordingly, the participant of the electronic auction has the right to submit an extract from the Unified Register of Small and Medium-Sized Enterprises, certified by a strengthened qualified signature, as a declaration.
