Purchases under Federal law No. 44: anti-dumping measures during the auction are not always applied

The Finance Ministry explained that anti-dumping measures are not applied if an electronic auction is held at the price of a unit of goods, work or service.

According to the Federal law No. 44, anti-dumping measures are applied if the initial (maximum) contract price is reduced by 25% or more during a tender or auction. In the case of carrying out the purchase at a unit price, the initial maximum price of contract is not reduced.

Recall that purchases at the price of a unit of goods, work or services are carried out when it is impossible to determine in advance their volume. Among such purchases are repair and maintenance of machinery, medical and legal services, transportation of goods and passengers.
