The same name of goods does not prevent their purchase from a single supplier

FAS pointed out that the following restrictions were established for purchases from a single supplier:

- on the amount of the contract;

- the annual volume of such purchases.

Other restrictions, including the number of contracts and the same name for the goods, works or services procured, Law No. 44-Federal Law does not provide.

We believe that the department will not have claims to customers who purchase the same goods for a total of more than 100 thousand rubles. under several contracts with a single supplier. At the same time, the annual limit for such purchases should not be exceeded.

It should be noted that in this situation it is safer to use competitive methods, since in the practice of ships there is an opposite position on this issue.
